The completed Application for Authority and statutory filing fee of $225, made payable to the Department of State, should be forwarded to the Department of State, Division of Corporations, 41 State Street, Albany, NY 12231. However, if the foreign corporation has been conducting business in New York State prior to filing its Application for Authority, it must obtain the consent of the State Tax Commission (Â§1304 (a)(8), Business Corporation Law). To obtain the consent, the completed Application for Authority and fees must be sent to the Department of Taxation and Finance, Corporation Tax Bureau, W.A. Harriman State Campus, Albany, NY 12227. Upon consenting to the filing, the Department of Taxation and Finance will forward the Application for Authority and fees directly to the Department of State for filing.
