Conditional Use Permits Required for Short Term Rentals in Palm Desert

Residents operating short term rentals in Palm Desert must now get a conditional use permit in addition to the city business license and/or transient occupancy tax permit they were previously required to obtain.

The ordinance passed in March obligates residents in non-gated neighborhoods who rent their homes between three nights to thirty days to obtain the permit.

City officials have instituted this ordinance as a means to try to control conditions in rental properties often dubbed “party homes.”

“The Conditional Use Permit restricts the number of days a home could be rented, the number of occupants in the home, parking and noise levels. The permit also requires owners to provide contact information to neighbors and the city,” reports Patch.

Additionally, anyone applying for the conditional use permit is subject to a public hearing by the Palm Desert Planning Commission before being approved.

There is a one-time charge of $500 to obtain the conditional use permit. Residents who already have a city business license can avoid paying this fee by registering with the Planning Department to be "grandfathered," before July 13, 2011.
