Police Summons Business Owner for Failing to Pay Meals Tax

Michael Paul Willis, the owner of Nielsen's Custard, received a summons from the police for being lax about paying Vienna, VA meals tax. He was charged with four class one misdemeanors for failing to pay the meals tax from July to October 2011.
Meals tax in Vienna, VA is a 3% tax charged to customers on qualifying food sales, which in turn must be paid to city officials by business owners. Business owners who don’t pay meals tax are considered to be embezzling city funds. This was not the first time Willis was charged this year for embezzling meals tax funds. Willis was also charged this year for failing to pay Vienna, VA business license fees, see earlier post.
As reported by Vienna Patch, “In May, police issued five misdemeanor warrants for Willis, charging him twice for failing to obtain a business license and three times for not filing meals tax returns. Willis pled guilty to two misdemeanor counts of failure to obtain a business license Aug. 15. The embezzlement charges for failure to pay meals taxes were dropped because those outstanding funds had been paid to the town."
Willis’s current charges could bring him up to 12 months in prison and/or penalties up to $2,500 if he is convicted.
