Nevada Subpanel Reverses 2009 Business License Ruling

Thousands of home-based businesses will now be required to obtain a Nevada business license thanks to Thursday night’s ruling by The Legislative Commission’s Subcommittee to Review Regulations. This is a large victory for Democrats who have been trying to reenact this requirement since a 2009 ruling exempted home-based businesses, who earn less than $27,000, from paying the business license fee.

The Nevada News Bureau reports that with the passage of the subpanel’s ruling, home-based businesses operating as limited liability companies and corporations that earn less than $27,000 will be required to obtain the $200 Nevada business license. It does not apply to individuals operating businesses out of their homes.

As reported in an earlier post, proponents of the bill claim that many of the LLC’s and corporations filing as home-based businesses are in fact regular brick and mortar establishments who in fact should be paying business license fees. Secretary of State Ross Miller believes that the state is losing an annual $10 million in unpaid business license fees from businesses that are using the home-based business loophole to evade paying their taxes.

On the other hand, Republicans who oppose the bill feel that individuals who have chosen to form a LLC or corporation for legal protection purposes in order to operate a side home-based business will be hurt by the additional fees now required of them.
