Will Nevada Collect Business License Fees from Home-Based Businesses?

The Nevada Legislative Commission deferred action on Secretary of State Ross Miller’s proposed regulation to allow for the collection of business license fees from home-based businesses. Current regulations exempt home-based businesses, earning less than $27,000, from paying Nevada business license fees.

Miller believes that the state is losing $10 million annually on businesses who claim to be eligible for the exemption and really don’t qualify. Many LLC’s and Corporations are filing for the exemption, some of them conducting businesses such as bowling alleys and nail salons which by nature aren’t home-based businesses.

Miller doesn’t have the authority to impose his proposed regulation of only allowing natural persons conducting business to claim the exemption. Last Wednesday, the State’s Legislative Commission, who legally can change the current regulation, chose to defer action on Miller’s proposal.

The Las Vegas Review Journal reports that “The Legislature does not meet until next year.” As such, Miller’s proposal remains in limbo.
