Hiring an Illegal Immigrant could cause Revocation of One’s Business License in Alabama

Alabama Governor Robert Bentley signed the ‘Beason-Hammon Alabama Taxpayer and Citizen Protection Act’ today, Thursday, June 9, 2011 that would enforce strict measures to stop illegal immigrants from settling in Alabama. Amongst other provisions, the law requires business owners to check immigration status of their employees using the national E-Verify program. Any employer who violates the above law could face revocation of his business license.

However, using the national E-Verify program can save one from losing his business license if he mistakenly hires an illegal immigrant. As Littler reports, “any employer that utilizes E-Verify will be immune from any liability under the act for knowingly employing an unauthorized alien.”

The first violation of the Beason-Hammon Alabama Taxpayer and Citizen Protection Act will cause a temporary suspension of an one’s business license until he comes into compliance with the law. The second violation, however, could result in a permanent revocation of a business license.

Alabama joins other states in using revocation of employers’ business licenses as a means to control illegal immigration.
