Will South Carolina’s Illegal Immigration Act Prevail?

The Obama Administration and the U.S. Justice Department filed a lawsuit against South Carolina yesterday as part of their effort to stop the trend of state action against illegal immigration.

As explained in an earlier post, South Carolina passed a bill in June that would penalize business owners who hire illegal immigrants by revoking their South Carolina business licenses. The bill is slated to go into effect by January 1 of next year.  

The Washington Times reports that “Justice Officials said they will request an injunction to block the law from going into effect on Jan. 1.”

The issue over Southern states’ attempt to control illegal immigration has sparked controversial debates in the last couple of months as citizens struggle to obtain much needed work positions which may already be filled by illegal immigrants. Proposed penalization for the hiring of illegal immigrants is harsh in the states that have enacted their own bills to combat this nationwide problem, including but not limited to the loss of one’s business license.
