Illinois Officials Enforce Dairy License Regulations

Kris Swanberg, owner of Nice Cream, never heard of the Illinois dairy license when she began selling ice cream a few years ago. She followed the accepted procedure and applied for a Chicago, IL business license, filled out the correct forms, paid her fees and began selling an original recipe of frozen ice cream.

An Illinois Department of Public Health representative visited Logan Square Kitchen, a commercial kitchen use by operators of small food businesses, a couple of weeks ago and informed Swanberg that unless she obtained an Illinois dairy license she would be shut down.

In order to obtain the dairy license, Swanberg’s ice cream would have to abide by numerous regulations including using pre-made ice cream mix and strawberry syrup instead of the fresh variety that uniquely marks and markets Nice Cream.

The dairy license requirement shocked Swanberg and other local ice cream makers. As reported by the Chicago Tribune, “Swanberg and others in her field had operated for years now without ever hearing of such a thing and, indeed, they say, the City’s Department of Business Affairs and Consumer Protection, to whom they applied for business licenses, never informed them they would need one to operate.”

Other local ice cream makers are afraid that they will be next and their Chicago business licenses will be rendered invalid unless they obtain a state dairy license.
